Ohio is contacting about 5,000 non-domiciled CDL holders after FMCSA guidance tightened which immigration documents qualify for commercial driving credentials.

Ohio is reviewing about 5,000 non-domiciled commercial driver's licenses as states respond to tighter federal eligibility guidance for commercial drivers who are legally allowed to work in the U.S. but are not permanent residents.

The Ohio Bureau of Motor Vehicles said it will contact affected CDL holders to determine whether their credentials still comply with updated Federal Motor Carrier Safety Administration standards. The review does not apply to full CDL holders or drivers with legally established permanent residence.

Downgrades are possible

Ohio has about 406,000 CDL holders. For the group under review, drivers whose documents no longer meet FMCSA standards will receive a notice that their commercial license will be downgraded to a standard Class D license 30 days after the notice.

A downgrade would prevent the driver from operating commercial vehicles in the U.S. on that Ohio-issued credential. Drivers who believe they remain eligible can request a hearing or submit additional documentation.

Under current federal guidance, acceptable documents include an unexpired Employment Authorization Document from U.S. Citizenship and Immigration Services or an unexpired foreign passport with a valid I-94 arrival/departure record. Ohio also said it has stopped issuing new non-domiciled CDLs and does not plan to renew existing non-domiciled credentials after they expire.

A wider state-by-state reset

The Ohio review follows FMCSA guidance issued in September 2025 and a final rule that took effect March 16. California, Washington, Colorado, and Pennsylvania have paused processing non-domiciled CDLs or commercial learner permits while federal officials review state compliance.

For motor carriers, this is a credential-audit story. Fleets using non-domiciled CDL holders need clean expiration tracking, document follow-up, and contingency plans if a driver's commercial privileges are downgraded before renewal.
